Terms and Conditions of Sale - Brandolia

1. Purpose and Presentation of Products
These Terms and Conditions of Sale (hereinafter the "T&Cs") govern the sale of digital subscriptions offered by Brandolia (brandolia.io), a French SaaS application. Brandolia allows users to generate a complete brand identity using artificial intelligence, including logo, slogan, storytelling, color palette, typography, and showcase website. Access to the service is provided through different subscription plans (monthly or annual).
2. Price, Duration, and Renewal
Subscription prices are indicated in dollars and include all taxes. The current rates are those displayed on the pricing page of the brandolia.io website at the time of subscription.
Subscriptions are offered for a monthly or annual duration. Unless terminated by the user or Brandolia under the conditions set out herein, the subscription will be tacitly renewed for the same duration as initially subscribed.
3. Payment Methods
Subscription payments are made via the secure Whop platform. By subscribing, the user accepts the general terms of use and sale of Whop, in addition to these T&Cs. Brandolia does not have access to the user's confidential payment information.
Payment is due at the time of the initial subscription and on each renewal date for subsequent periods.
4. Right of Withdrawal
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a tangible medium where the performance has begun after the consumer's express prior agreement and express waiver of their right of withdrawal.
By subscribing to a Brandolia subscription and immediately accessing the service (performance of the service beginning upon confirmation of payment), the user expressly waives their right of withdrawal, in accordance with legal provisions.
5. Refund Policy
Given the nature of the digital services provided and the waiver of the right of withdrawal upon subscription (immediate performance of the service), Brandolia does not offer refunds for commenced subscription periods, whether monthly or annual.
In case of a major service malfunction attributable to Brandolia that cannot be resolved, compensation may be considered on a case-by-case basis, without constituting a general obligation to refund.
6. Termination and Account Deletion
The user can terminate their subscription at any time from their personal space on the Brandolia platform or via the Whop platform according to the subscription management procedures. Termination will take effect at the end of the current subscription period. No refund will be issued for the remaining period.
In case of non-payment or a serious violation of the Terms of Use, Brandolia reserves the right to suspend or terminate the user's subscription, and to delete their account after prior notice has remained without effect.
Account deletion results in the loss of access to the service and the deletion of associated data, in accordance with our privacy policy.
7. Applicable Law and Dispute Resolution
These T&Cs are governed by French law.
In case of a dispute between the user and Brandolia, the parties will endeavor to find an amicable solution. In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Brandolia adheres to the Consumer Mediator Service [Name and contact details of the mediator to be inserted if Brandolia adheres to it]. The user can use this mediation mechanism free of charge. In case of failure of mediation, French courts shall have sole jurisdiction.
Brandolia is not currently affiliated with any consumer mediation service. In case of a dispute, an amicable solution will be preferred before any legal action.
